Barclays' Diamond quits over rate rigging

LONDON (Reuters) - Barclays chief executive Bob Diamond suddenly quit on Tuesday over an interest rate-rigging scandal that threatens to drag in a dozen more major lenders but suggested the Bank of England had encouraged his bank to manipulate the figures.

"The external pressure placed on Barclays has reached a level that risks damaging the franchise - I cannot let that happen," said Diamond, 60. The terms of his severance were not announced, though Sky News said the bank would ask Diamond to forfeit almost 20 million pounds in bonuses.

Politicians and newspapers have zeroed in on the scandal - which revealed macho e-mails of bankers congratulating each other with offers of champagne for helping to fiddle figures - as an example of a rampant culture of wrongdoing in an industry that stayed afloat with huge taxpayer bailouts.

Barclays released an internal 2008 memo from Diamond, then head of its investment bank, suggesting that the deputy governor of the Bank, Paul Tucker, had given Barclays implicit encouragement to massage the interest figures lower during the peak of the financial crisis in order to present a better picture of the bank's financial position.

According to the memo, Tucker told Diamond he had received calls from senior government officials. "It did not always need to be the case that we appeared as high as we have recently," Diamond said he had been told.

The Bank declined to comment, but analyst Ian Gordon at Investec said: "Based on first inspection it does seem to suggest that Barclays have received a message from the Bank which provided, to put it mildly, significant encouragement.

"So they're maybe trying to share the blame but with justification. It raises a whole bunch of questions, and they're very serious and they're for the Bank to answer."

However, Alistair Darling, Britain's chancellor at the time, said he found it hard to believe that the central bank would have made such a suggestion: "What Bob Diamond or Barclays appear to be saying is that the Bank (of England) told them to do this," said Darling, whose Labour party is now in opposition.

"I would find it absolutely astonishing that the Bank would ever make such a suggestion and equally I can think of no circumstances that anyone, certainly in the department which I was responsible for - the Treasury - would ever suggest wrongdoing like this," he told Channel Four television.

Noting how the central bank provided cash to help ease the upward pressure on commercial banks' borrowing costs, he said: "Policy was changed in order to get that rate down.

"However it would have been reprehensible and wholly unforgivable if anyone had attempted to try and manipulate this rate by simply putting in false figures."

SUDDEN REVERSAL

Diamond's resignation was a sudden reversal, hours after the American said it was down to him to clear up the mess at Britain's third-largest bank, fined nearly half a billion dollars for its part in manipulating the benchmark interest rate used to price everything from derivative instruments to home loans.

There was speculation in banking circles over whether Diamond, one of Europe's highest paid bankers and once labelled by a Labour minister as the "unacceptable face" of banking, jumped or was pushed.

Prime Minister David Cameron had announced a parliamentary inquiry after calling for Diamond to take responsibility for the scandal, and the Financial Services Authority regulator had also brought pressure to bear on the board.

The government is now considering the introduction of criminal sanctions for serious misconduct in the management of a bank, the finance ministry said on Tuesday.

FSA Chairman Adair Turner said on Tuesday he had had private conversations with Barclays since Friday morning about the need for "cultural change" at the bank.

"We communicated to the board those were the sort of issues they needed to think about, but it was for them to decide whether they could achieve that degree of change ... under the current leadership," he said.

Diamond sent a long letter to staff on Monday making clear his resolve to continue. But he and the board decided he should quit later that day after Cameron and chancellor George Osborne announced the parliamentary inquiry.

"A FIRST STEP"

Diamond's resignation was "a first step towards that change of culture, that new age of responsibility we need to see", Osborne told BBC radio.

"The chairman of Barclays phoned me last night to let me know that this was the decision of the board and of Mr Diamond, and I think Mr Diamond made the right decision," Osborne said.

Diamond will appear before the parliamentary inquiry on Wednesday, where his memo on the attitude of the Bank towards the manipulation of the interest rate at the time is likely to take centre stage. His evidence will have legal immunity.

Outgoing chairman Marcus Agius will lead the search for a new CEO, despite having announced his own imminent departure a day earlier. Newly appointed Chief Operating Officer Jerry del Missier, long a Diamond lieutenant, also left.

The reversal was a shock within the 322-year-old bank, which in recent years has boasted an aggressive culture cultivated by Diamond, first as head of investment banking and then as CEO. One Barclays banker, asking not to be identified without permission to speak publicly, said staff were disappointed.

"Everyone here has been bandying around names, but it's going to be hard to find someone of the same quality as Bob and John (Varley, his predecessor). I guess it would be hard to appoint someone from the investment banking side now."

Barclays has admitted it submitted falsely low estimates of its borrowing costs to calculate interbank rates from late 2007 to May 2009, a time when Diamond ran investment banking. Large banks' estimates of the interest rates they pay each other are used to calculate the London Interbank Offered Rate, or Libor, basis for trillions of dollars in contracts around the globe.

By manipulating the figures, banks could give flattering impressions of their financial strength. Barclays says it submitted low figures because it thought rivals were doing the same and higher rates would have made it seem to be in trouble.

The Libor figures submitted by banks are compiled by Thomson Reuters, parent company of Reuters, on behalf of the British Bankers' Association.

Opposition Labour Party leader Ed Miliband, who has said he wants to see criminal prosecutions of Barclays bankers, welcomed Diamond's resignation but said a parliamentary inquiry was not enough and demanded an independent probe led by a judge.

"This is about the culture and practices of the entire banking system, which is why we need an independent, open, judge-led, public inquiry," he said.

The government said a judge-led inquiry would take too long to be of use shaping new laws to tighten rules. Cameron, elected in 2010, has repeatedly made the point that Miliband's Labour was in power at the time of the wrongdoing.

NAMES IN THE FRAME

Antony Jenkins, currently chief executive of Barclays retail and business banking, is the most likely internal candidate to replace Diamond, said Oriel Securities analyst Mike Trippitt. However, the firm may choose to look outside for a new leader to turn the page on the scandal.

"Promoting an existing manager might not look like it is doing enough to tackle problems with aspects of the bank's culture which the LIBOR scandal has exposed," one top 25 Barclays investor said, asking not to be identified.

Other names in the frame include former JPMorgan investment banking co-head Bill Winters and Naguib Kheraj, the ex-Barclays finance director and former CEO of JPMorgan Cazenove.

"I struggle to see many worthy candidates to replace him," said a top 40 investor.

Barclays shares, which rose on the news of the departure of Agius on Monday, were down 1.1 percent late on Tuesday at 166.5 pence, while the European banking stocks index was flat. The shares were down more than 15 percent from Thursday's open.

Barclays was fined $453 million by U.S. and British authorities, the first bank to settle in an investigation that is looking at more than a dozen others, including Citigroup, UBS and RBS.

U.S. storms kill 13, cut power to millions

WASHINGTON (AP) ? It could be several more days before electricity is restored to areas hit by vicious storms that killed at least 13 people and left 3 million power customers to negotiate sweltering temperatures without air conditioning.

Across a swath from Indiana to New Jersey and south to Virginia, officials warned the heat wave could take a toll on the elderly, young or sick. Problems from the storms that began Friday ranged from a damaged prison in Illinois to tree-strewn train tracks that stranded 232 Amtrak passengers for more than 20 hours in West Virginia.

Emergencies have been declared in Maryland, West Virginia, Ohio, the District of Columbia and Virginia, where Gov. Bob McDonnell said the state had its largest non-hurricane outage in history, as more storms threatened. "This is a very dangerous situation," the governor said.

Maryland Gov. Martin O'Malley said utility crews were working to untangle downed tree limbs and power lines. The fact these storms were so unexpected has added to the challenge. Crews are traveling from as far away as Florida and Texas to help, O'Malley said Sunday on CNN's "State of the Union."

"Unlike a polite hurricane that gives you three days of warning, this storm gave us all the impact of a hurricane without the warning of a hurricane," he said.

Power officials said the outages wouldn't be repaired for several days to a week.

The bulk of the storm damage was in West Virginia, Washington and the capital's Virginia and Maryland suburbs. At least six of the dead were killed in Virginia, including a 90-year-old woman asleep in her bed when a tree slammed into her home. Two young cousins in New Jersey were killed when a tree fell on their tent while camping. Two were killed in Maryland, one in Ohio, one in Kentucky and one in Washington.

In Washington's northern Virginia suburbs, emergency 911 call centers were out of service; residents were told to call local police and fire departments. Huge trees toppled across streets in the nation's capital, crumpling cars. Cellphone and Internet service was spotty, gas stations shut down and residents were urged to conserve water.

The power outages were especially dangerous because they left the region without air conditioning in an oppressive heat wave. Temperatures soared to highs in the mid-90s Saturday in Baltimore and Washington, a day after readings of up to 104 degrees were reported in the region. Yet another day of temperatures reaching 100 degrees was forecast for much of the region Sunday.

Three Baltimore City fire companies set to permanently close this week were staying open several more days to help cope.

Utility officials said it could take at least several days to restore power to all customers because of the sheer magnitude of the outages and destruction. Winds and toppled trees brought down entire power lines, and debris has to be cleared from power stations and other structures.

New Jersey Gov. Chris Christie ordered the National Guard to deliver fuel for generators and fresh water to stricken areas. He reported that power had been restored to such tourist areas as Atlantic City's casinos.

Illinois corrections officials transferred 78 inmates from a prison in Dixon to the Pontiac Correctional Center after storms Friday night caused significant damage in the state, Department of Corrections spokeswoman Stacey Solano said.

No one was injured, Solano said. Generators are providing power to the prison, which is locked down, confining remaining inmates to their cells.

In West Virginia, 232 Amtrak passengers were stranded Friday night on a train blocked on both sides of the tracks by toppled trees.

Brooke Richart, a 26-year-old teacher from New York City, was among the passengers stranded for 20 hours. She read half a book and took walks outside the train, which had light, air conditioning and food the entire time. But she called the wait "trying."

"Thankfully we could go in and out of the train because we were there so long. If you wanted to stretch your legs or take a walk, you could," she said.

Amtrak spokesman Steve Kulm said passengers were taken away by buses Saturday night.

Some major online services also saw delays and disruptions.

Netflix, Instagram and Pinterest resorted to using Twitter and Facebook to update subscribers after violent storms across the eastern U.S. caused server outages for hours. Netflix and Pinterest restored service by Saturday afternoon.

Instagram used its Facebook fan page to communicate with users of its photo-sharing service. It posted a message on Saturday morning that blamed the electrical storm for the outage that sent its engineers scrambling to restore service.

Meanwhile, utilities said they were struggling to restore power amid the heat wave.

"We do understand the hardship that this brings, especially with the heat as intense at is. We will be working around the clock until we get the last customer on," said Myra Oppel, a spokeswoman for the utility Pepco, which serves Washington and its suburbs.

Especially at risk were children, the sick and the elderly.

In Charleston, W.Va., firefighters helped several people using walkers and wheelchairs get to emergency shelters. One of them, David Gunnoe, uses a wheelchair and had to spend the night in the community room of his apartment complex because the power ? and his elevator ? went out. Rescuers went up five floors to retrieve his medication.

Others sought refuge in shopping malls, movie theaters and other places where the air conditioning would be cranked up. Others simply tried to make the best of a bad situation.

In the Columbus, Ohio, suburb of Dublin, Lori Schaffert said her household borrowed a generator from a friend and was alternating it between the refrigerator and freezer while using flashlights and battery-operated lanterns for light. Her 5-year-old daughter and a neighbor friend played board games and helped her make pickles from their garden's cucumbers.

"You come to appreciate the simple life a little more in these times," Schaffert said.

A Glut of Obesity Drugs?

On June 27, the FDA approved the first new weight-loss drug in 13 years, Arena?s lorcaserin (Belviq). The track record for anti-obesity drugs has not been very good?each has been withdrawn from the market, after approval, due to safety concerns. Why was this drug approved? How long will this one last before being yanked for adverse events?

Let?s look at the background and track record of lorcaserin?s predecessors.

Perspective on the need for weight loss drugs

Why the brouhaha over Arena?s new drug?

According to the Centers for Disease Control and Prevention, more than one-third of adults in the United States are obese, defined as having a Body-Mass Index (BMI) of ?> 35. In the U.S. alone, 78 million U.S. adults are? obese; another 34% of adults are overweight > 30. So 70% of U.S. adults have a problem with weight. Worldwide, CDC estimates 500 million are currently affected. Overweight and obesity constitute the second leading cause of preventable death, after smoking, resulting in an estimated 300,000 deaths per year. The number of obese is expected to rise to 42% by 2030, with an additional 11% prevalence of severe obesity (BMI >40, or ~80+ lbs overweight).

In 2000, consumers spent approximately $35 billion on weight-reduction products and services; it is undoubtedly more now. There is enormously aggressive?and misleading?advertising for these products. The Federal Trade Commission noted that about half of these ads were false.

Annual health-care costs for patients with BMIs of 20 to 24.9 were 20% lower than costs for ?overweight? patients with BMIs from 30 to 34.9 and almost 33% lower than for ?obese? patients who had BMIs of 35 or more. There has been a steady increase in obesity over the past several decades, though this appears to be tapering off a bit. Finkelstein et al. estimate that costs of obesity may be as high as $147 billion per year, or roughly 9% of U.S. annual medical expenditures. ?If obesity were to remain at 2010 levels, the combined savings in medical expenditures over the next 2 decades would be $549.5 billion.?

With such a huge health problem comes a correspondingly large business opportunity. According to Ernest Trent, cited in Bloomberg News, sales for Arena?s new drug may hit $2 billion by 2020.

Even modest weight loss, of 5-10%, is enormously difficult to achieve with diet, exercise, and behavior modification. Yet even that is enough to demonstrate significant health benefits?a reduction in diabetes or cardiovascular disease. Unfortunately, as many of us know all too well, such weight loss is often like a flash in the pan, enticing but all too transient.

One of the problems, to date, is that drugs that have been researched only show this modest benefit of 5% weight loss better than placebo. And the drug efficacy tends to plateau over time. Finally, weight is regained when the drugs are stopped. All of this leads to a lot of consumer and industry pressure to develop and approve new drugs. What often seems to be ignored is the contribution that the food industry makes to the problem through heavily advertised unhealthy offerings.

How obesity drugs work. What are their targets?

There are a number of different approaches pharmaceutical companies are taking to researching and developing drugs for obesity. The bottom line is that you need to ?reduce energy intake? or ?increase energy expenditure,? a professional way of saying eat or absorb less, or burn more calories through deliberate exercise or revved-up metabolism (thermogenesis). The paths companies are taking to this end are different.

Lois et al. provide a good overview of the physiology, if you are not faint of heart. Briefly, signals from the GI tract control our appetite by working closely with our brains to signal the need for food intake. There are chemical messengers from the upper GI tract (e.g., Cholecystokinin?(CCK), secretin and GIP (glucose-dependent insulinotropic peptide or gastric inhibitory polypeptide), lower intestine (Glucagon-like peptide-1), from adipose tissue (leptin) and from the pancreas (insulin). These all communicate with the hypothalamus in our brains, and thus tell us whether to seek food (orexic) or fast (anorexic). For example, ghrelin enters the brain and increases our appetite (is orexigenic), while insulin and leptin do the opposite, having an anorexigenic signal.

Let?s look at where some of the anti-obesity drugs under development act.

Sympathomimetic drugs are related to stimulants. This acts as an appetite suppressant, and causes a feeling of early satiety, or fullness. Side effects include tachycardia (rapid heart beat) and elevated blood pressure. Many also have significant interactions with antidepressants and alcohol.

One member of this class, sibutramine (Meridia), worked by blocking both norepinephrine and serotonin reuptake. Sibutramine has since been withdrawn from the market due to cardiovascular safety concerns?hypertension and myocardial infarction.

Phentermine and diethylpropion, which stimulate the release of norepinephrine, are still marketed, but are indicated only for short term (<12 week) use, because they are classified as Schedule IV drugs, as having the potential for abuse.

The selective serotonin reuptake inhibitors (SSRIs) fluoxetine and bupropion (Wellbutrin), used for depression, have mild weight loss effects as well.

Pancreatic lipase inhibitors or gut absorption

Another weight loss mechanism is by impairing fat absorption and digestion, as is the case with Orlistat (Xenical, Alli), currently the only marketed FDA approved drug for obesity. Modest weight loss has occurred in a number of studies. There have been a number of reports of ?fecal incontinence? as well as malabsorption of vitamins. Kidney stones and rare liver injuries have also been reported.

Neurotransmitter receptors

Rimonabant (Acomplia), which worked by blockading the endocannabinoid system, was sold in Europe briefly by Sanofi-Aventis. It was withdrawn because of reports of severe depression and suicide, thought to be a result of drug antagonism at the cannabinoid CB1 receptor in the brain.

Lorcaserin is a novel 5-hydroxytryptamine 2C (5HT2C) receptor agonist developed for obesity treatment. The 5HT2C receptor is concentrated in the central nervous system (CNS) where it regulates feeding behavior. Lorcaserin targets activation of the serotonin 5HT2C receptor.

There are other brain receptors under study as targets for drugs including the gut peptides glucagon-like peptide receptor 1 (GLP-1), Y receptors, ghrelin and melanocortin receptors.

Gut hormone mimetics

Exenatide (Byetta), a drug for diabetes, is an analogue of the intestinal hormone GLP-1, which produces satiety (a sense of fullness) by delaying gastric emptying. Similarly, Pramlintide (Symlin), is an analog of the pancreatic hormone amylin, which also causes delayed gastric emptying. Liraglutide (Victoza, Novo Nordisk), another glucagon-like-peptide-1 (GLP-1) receptor agonist, was approved in 2010 to improve glucose control, although it only reduced ?glycated hemoglobin concentration of 0.8 to 1.4 percentage points as compared with placebo.? This seems small benefit to me, given the potential increase in pancreatitis and tumors (the latter in animal studies). Both drugs have weight loss benefits, though their indication is for diabetes.

Cholecystokinin (CCK) is produced in the duodenum (where the stomach enters the small intestine) and jejunum (upper portion of the small intestine) and signals satiety via the vagus nerve. It also delays gastric emptying. So far, no drugs have successfully exploited this mechanism of just stimulating satiety.

Other potential targets include:

Angiogenesis Antagonists (inhibit new blood vessel formation)
Neuropeptide mimetics
Neuropeptide Y (NPY) inhibitors

Adipokine mimetics. Adipokines are proteins secreted by adipose (fat) cells.
Leptin is a peptide (amino acids, protein precursor) in adipose tissue that stimulates the hypothalamus and??? promotes satiety. Obese patients tend to have high levels of leptin and are ?leptin-resistant.?

Combinations of drugs with different mechanisms of action are sometimes used. For example, Vivus? QNEXA is a fixed-dose combination of phentermine hydrochloride and an old anti-seizure medication, topiramate.

History of anti-obesity drugs and why they failed

1997 Fen-Phen, a combination of fenfluramine and dexfenfluramine, sold as Redux, was pulled from the market because of causing heart valve abnormalities.

2004 Another, phenylpropanolamine, was withdrawn because of increased strokes. Ephedrine was also banned by the FDA as its amphetamine like action caused high blood pressure and cardiovascular deaths. In 2005, a suit by Nutraceutical claiming that the FDA had wrongly regulated ephedra as a drug, rather than as a food supplement, caused the ban to be lifted. ?The judge said the law requires the FDA to prove that a dietary supplement is harmful, rather than requiring the manufacturer to prove it is safe, as is required with drugs.? Then in 2007, a federal appeals court upheld the FDA?s original ban, citing the high number of adverse events attributed to the drug.

2007 Rimonabant (Acomplia) was withdrawn because of reports of severe depression and suicidal ideation, even in patients without a prior history of depression.

2010 Sibutramine (Meridia) was removed from the market due to cardiovascular safety concerns?hypertension, myocardial infarction and strokes.

2010 Qnexa failed to win FDA approval, due to safety concerns: suicidality, cognitive dysfunction, metabolic acidosis, cardiovascular safety, and the potential teratogenic (20-fold increase in cleft palates) effect of PHEN/TPM. It is up for reconsideration next month.

2011 FDA requested a clinical trial specifically to look at the cardiovascular safety of the combination drug bupropion and naltrexone (Contrave, by Orexigen).

FDA guidance

In 2007, the FDA issued a Guidance for Industry: Developing Products for Weight Management. Their recommendations included:

  • The duration of the phase 2 trials should be sufficient to capture the maximal or near-maximal weight loss effects of the active? doses;
  • Patients should have BMIs greater than or equal to 30 kg/m2 or greater than or equal to 27 kg/m2 if accompanied by comorbidities (other significant illnesses, as diabetes or heart disease);
  • Primary efficacy endpoint? should be a comparison of the change in body weight between the active-product and placebo-treated groups? and the proportion of patients in each treatment group who lose greater than or equal to 5 percent of baseline weight.

These criteria were all met in the Lorcaserin trials.

Lorcaserin

So let?s look back at Lorcaserin, a drug that the FDA rejected in 2010.

What changed their minds now? In Arena?s original submission, which included more than 7000 patients in their Phase 3 trials, the mean placebo-subtracted weight loss at Week 52 from baseline with lorcaserin 10 mg BID (twice daily) was 3.3%. Follow up studies, the BLOOM-DM trial, have shown a modest improvement in glucose control.

Reviewing all data, the FDA found:

  • Based on echocardiograms, a relative risk of 1.16 for valvular heart disease (VHD), defined as mitral regurgitation greater than mild or aortic regurgitation greater than trace;
  • a small imbalance in serious adverse events of depression, discontinuations due to adverse events of depression, and suicidality scores (and this was in studies that specifically excluded patients with a prior history of treatment for depression within 1-2 years);
  • cognitive impairment was seen more frequently in the lorcaserin-treated patients

Arena will have to conduct six follow-up safety studies, including whether Lorcaserin increases the risk of heart attack or stroke. (Post-marketing commitment studies have a poor track-record for enforcement, though there are now relatively small financial penalties for noncompliance.) Attention will also be given to valvular disease, as the Phase 3 trials excluded patients with significant underlying valve disease. The FDA advisory committee noted, ?There?s probably not sufficient data at this time to rule out a clinically meaningful increase in the risk for valvular heart disease.? Given that heart attacks and valvular disease was what killed previous anti-obesity drugs (to say nothing of patients), it is surprising that the committee voted for approval. I suspect this will follow the pattern of other drugs?when any drug is released on the market, it is used by a broader population, including those with higher risk for adverse outcomes (e.g., people with underlying heart disease or more serious depression). Since the groups won?t be cherry-picked to produce the best outcome, it is quite possible that problems will soon become evident, and lorcaserin will ultimately be withdrawn. That will likely be a painful process, as the same group that approved the drug is also responsible for taking regulatory action against it post-marketing.

Conclusions:

The U.S. Preventive Services Task Force concluded that because of safety problems and a lack of data showing that people can keep weight off after discontinuing diet medications, the task force could not recommend that anyone use diet drugs. While modest weight loss has been seen, inadequate evidence was found about the effectiveness of these interventions on long-term health outcomes (for example, mortality, cardiovascular disease, and hospitalizations).

Given the very modest weight reduction seen with Lorcaserin (Belviq) and other anti-obesity drugs, that the weight loss is transient, and that there is inadequately demonstrated benefit, the FDA?s approval of this drug seems to be another example of the FDA bowing to industry. As Public Citizen?s Sidney Wolfe noted, ?Marketing this drug to a population besieged by obesity and desperate for relief is irresponsible and a mistake that will benefit only the company that makes it.?

While this was said about the FDA?s approval of lap bands for weight loss, it seems as applicable today: ?Today?s FDA report gives the impression that FDA backed down on several safeguards as a result of unfavorable comments,? Dr. Diana Zuckerman of the National Research Center for Women and Families said in a statement. ?FDA decisions should not be based on a popularity contest, especially since lobbyists rig the results.? It is also quite striking that there are double standards with drug and device approval. Although the FDA has approved Locarserin, there has been no great rush to approve over-the-counter (OTC) Naloxone, a drug that treats overdoses and has an excellent safety record?known since at least 1996. There are roughly 15,000 opioid related deaths in the U.S. annually; 100 people die from drug overdoses every day in the United States alone. Naloxone has demonstrated far greater safety and efficacy than have drugs for weight loss. For some time, there have been efforts to have Naloxone be sold over-the-counter. What are we waiting for? But there is no politics at the FDA, right?

Some franchise players unhappy with union's 'favored' treatment of Brees

Perhaps unwittingly, the NFLPA didn't make a whole lot of friends among the franchise players in the league with last week's letter to commissioner Roger Goodell seeking an investigation of New Orleans' negotiations with "exclusive" franchise quarterback Drew Brees.

First reported by CBSSports.com, the letter suggests that the Saints haven't bargained in good faith, and that perhaps Brees has been a victim of his outspoken stance from last year's lockout. The problems are that the Saints have made Brees competitive offers that would make him one of the NFL's highest paid players, even if he hasn't signed them yet, and that there are other franchise players whose negotiations have gone far worse.

In essence, some of the franchise players or their representatives feel the NFLPA has granted Brees a kind of "favored nation" status. "Nothing against Drew, but he's kind of become [the union's] fair-haired boy," one franchise player noted. The agent for another of the franchise players said the NFLPA is treating the New Orleans quarterback "like some kind of a Messiah or something."

In fairness to Brees, it should be noted that he had nothing to do with the union's letter, as the NFLPA continues to grasp at straws, but his standing among some peers could be affected by it.

Of the 21 players designated as franchise free agents in the spring, six of them, beyond Brees, remain unsigned. This week, Jacksonville kicker Josh Scobee and agent Ken Harris said there haven't been any negotiations with Jaguars officials in months. Scobee allowed that the situation has been frustrating.

It's been more than a month since there were reports that Denver kicker Matt Prater was close to a deal with the Broncos, but, again, no deal.

Tailbacks Ray Rice and Matt Forte, wide receiver Dwayne Bowe and defensive end Cliff Avril are all without deals. Eight other franchise players have signed just one-year tenders.

So it would seem there's been a lack of progress on more than just the Brees front, yet the NFLPA has requested that Goodell look only into his case. Little wonder some of the other players with either no deals at all or just one-year tenders, are privately wondering why that is.

Gay Hate Crime In Hancock Park, LA: Homeless Man Beaten After Saying He Was Gay And Had AIDS

A gay homeless man was severely beaten near Hancock Park early Friday morning after he told his attacker that he was gay, homeless and had AIDS, as first reported by the LA Weekly.

The suspect, a white male, called the victim anti-gay discriminatory names and proceeded to "beat him up pretty bad with his hands and feet," Richard French of the Los Angeles Police Department told The Huffington Post. Police are investigating the case as a gay hate crime.

The victim, a white male in his mid-30s, collapsed and was taken to the hospital in critical condition. The alleged hate crime took place just before 1 a.m. on the sidewalk of the 100 block of N. Mansfield Avenue.

Another suspected gay hate crime took place in May in Echo Park. Two mid-20s men were called anti-gay slurs and then stabbed, although both survived. The attack was caught on tape, and a $25,000 reward has been offered for information regarding the suspects, who are still at large.

No other information is currently available about the suspect or victim of the Hancock Park beating. Anyone with information regarding this crime is asked to call the Hollywood Homicide Detectives at 213-972-2967.
